ATV Meeting Report

Sheriff’s Office and City Councilman Bill Lonkart spoke with owners about ATV Issues at a meeting held in the Town Center on November 3rd.  Representatives from the Sheriff’s Department, City Council member Bill Lonkart, and many VillageWalk homeowners discussed the issues surrounding the ATV’s on Bonita Beach Road and recent gunshots coming from the wooded area across from the VillageWalk Community. Captain Allen, in charge of the southern portion of Lee County, Lieutenant Tracy Sonier, Community Representative Office, and Sergeant. David Piasecki answered homeowner questions regarding enforcement and enforceability of City and County laws. The difficulty for the Sheriff’s Department and for VillageWalk is that the area north of Bonita Beach Road is owned by many different entities: private owners, the county and the state Fish and Wildlife Commission, stated Captain Allen. These properties are private properties, of which many owners have given permission for or the properties
have been designated for the purposes of ATV use and/or hunting when in season. The Sheriff’s department has no jurisdiction to enforce city trespassing laws on county property and/or state laws on these privately owned properties unless an agreement is reached with the property owner allowing access and enforcement. The property owner would have to sign an agreement with the Sheriff’s department and post no trespassing signs, stated Captain Allen. What the Sheriff’s department will enforce are
the following:
• ATV’s are prohibited from being driven on roads
• ATV’s are prohibited from being driven in the swales of
the road
• Parking in the posted No Trespassing areas is prohibited
• Shooting is prohibited within 1000 feet of a home or road
At Councilman Bill Lonkart’s request, the Sheriff’s department stated they will increase their presence in the area. Captain Allen encouraged homeowners to continue to call in with complaints. Please call 477-1200 and ask for the Complaint Desk when calling about ATV’s on Bonita Beach Road or to report gunshots.
City Councilman, Bill Lonkart will contact our Lee County Representative and our State Legislator to try to arrange a meeting here at VillageWalk to discuss possible solutions. Notices will be posted on Channel 95, at the Post Office and the Town Center when a meeting is arranged.
